EXCLUSIVE: Could Britney Spears Face Jail Time? What Friends Hope For the Star & How She’s Doing

Sources close to Britney Spears are expressing hope that a judge will give the pop star a choice between rehabilitation and jail time following her recent DUI arrest in Ventura, California. Friends believe this could provide her with a crucial opportunity for treatment and reflection.

Spears, 44, was arrested on the evening of March 4 and released early the next morning, March 5, after being detained until 6 a.m. TMZ was the first to report the arrest. The arrest was classified as a "cite and release," meaning she was not placed on probation. While details surrounding the incident remain sparse, sources indicate that Spears has been struggling in recent months, as seen in her Instagram posts. Her instagram account has since been taken down.

“She’s been in a tough place lately,” a source shared with Celebrity Intelligence. “This situation could serve as a reality check for her. She recognizes that her behavior hasn’t been great, and she wants to comply with the law.” Friends tell Celebrity Intelligence that she mentioned having only consumed a mimosa prior to being detained by police, although her blood alcohol content has not been disclosed.

In light of her arrest, those close to Spears are hoping the judge will consider her circumstances and potentially issue an ultimatum that forces her to choose between rehab or jail. In past celebrity cases, stars like Nicole Richie, Paris Hilton, and Lindsay Lohan have all served jail time for DUI offenses or probation violations stemming from them.

The source continues, “Everyone around her is hoping the judge threatens her with the choice of rehab or jail so that she commits to going to rehab.”

A representative for Spears commented on the incident to Celebrity Intelligence, describing it as “unfortunate and inexcusable.” They expressed hope that this could mark the beginning of necessary changes in her life, emphasizing her willingness to take the right steps moving forward.

As she navigates this challenging period, Spears is spending time with her two sons, Preston, 20, and Jayden, 19, while her family develops a plan focused on her well-being and recovery. The coming days will be crucial as the judge's decision looms, potentially shaping the next chapter in the life of this enduring pop icon.

Spears' history with alcohol is tied to her personal struggles of the mid-2000s, which were often highlighted during her 2007-2008 breakdown and subsequent conservatorship. Allegations of alcohol abuse were used to justify her conservatorship, which was established following a mental health crisis. In a separate 2007 ruling during her custody battle with Kevin Federline, a judge wrote that evidence showed Spears engaged in "habitual, frequent and continuous use of controlled substances and alcohol."

During her landmark public testimony on June 23, 2021, for her conservatorship hearing in court, she famously noted the irony of her forced sobriety given her stress, stating, "I don't even drink alcohol, but I should considering what they put my heart through."
